J. Cleve Livingston
is a founding partner of Boyden, Cooluris, Livingston & Saxe, P.C.
Mr. Livingston specializes in Land Use, Environmental, Real Estate, Housing
and Energy Law. Mr. Livingston's law
experience includes service as General Counsel to the California Department
of Housing and Community Development and as Senior Attorney -- Environmental
Litigation for the non-profit Conservation Law Foundation of New England. Over the past ten years, his practice has had as its principal focus
representation involving large development projects. Mr. Livingston typically acts as lead counsel with respect to the tasks
of securing project entitlements as well as implementing the development plan
once approved. Such representation
includes work as principal advisor with respect to the preparation and approval
of specific plans, development agreements, environmental impact reports, wetlands
and endangered species permits, infrastructure financing plans, assessment
district formations and related development permits and approvals. Mr. Livingston’s practice also includes the
preparation of Conditions, Covenants and Restrictions and all manner of development
related agreements as well as the formation of Home Owner Associations and
Business Property Owner Associations.
Mr. Livingston received his B.A., cum laude, in Government from Harvard College in 1969. He received his J.D. from Antioch School of
Law, Washington, DC in 1975. In 1982,
Mr. Livingston received a Master of Public Administration Degree from the
John F. Kennedy School of Government, Harvard University, with a concentration
in development economics.
Mr. Livingston is the author or co-author of the following publications: "Growth Controls, State Housing Regulations,
and the New Federal Program Requirements," Can We Afford Local Growth
Controls?, Institute of Government Affairs, University of California at Davis,
1977; The California Housing Element Manual, California Department of Housing
and Community Development, 1978; The Fair Share Planning Manual, California
Department of Housing and Community Development, 1978; Underground Petroleum
Storage Tanks: Local Regulation of a Groundwater Hazard, Conservation Law
Foundation of New England, 1984; and Fueling the Conservation Power Plant,
Conservation Law Foundation, 1992. Mr.
Livingston also served as principal author of the California Housing Element
Law (Government Code §§65580 et seq.).
Mr. Livingston’s pro bono legal work includes representation of affordable housing projects
in jurisdictions throughout California and service as General Counsel to Sacramento
2000 -- the Local Organizing Committee for the 2000 Olympic Team Track and
Field Trials.
Mr. Livingston was a member of the 1968 and 1972 Olympic Teams (silver medallist) and served
for many years on the United States
Men's Olympic Rowing Committee. He
also captained the Harvard crew and is a member of the Harvard Athletic Hall
of Fame. He presently serves as an
appointed member of the joint City/County Sacramento Sports Commission and
as Chair of the Sacramento Region Sports Education Foundation which acts as
the Local Organizing Committee for events such as the 1999 U.S. Gymnastics
Championships, the 2000 Olympic Team Track and Field Trials, and the 2002
First and Second Round NCAA Men’s Basketball Championships. In addition, Mr. Livingston is a member of the Board of Directors
of the Bay Area Sports Organizing Committee and the Sacramento Regional Representative
and Secretary to the Northern California Junior Tennis Council of the USTA.
Mr. Livingston is a member of the California State Bar and the Commonwealth of Massachusetts
Bar.
